• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
• Use the service for any illegal activity or to solicit the performance of illegal activities

4. Content Ownership and Rights

Your Content: You retain all ownership rights to the content you upload to Sonic Bloom, including your music, images, and text. We do not claim any ownership rights to your content.

License to Us: By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, display, and distribute your content solely for the purpose of providing the Service to you.

Copyright Compliance: You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the content you submit.

DMCA: We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe your copyright has been infringed, please contact us at hello@gosonicbloom.com.

AI-Generated Content: We may offer AI-powered content generation tools (powered by Claude by Anthropic) to help you create bios, descriptions, and other text content:

• AI-generated content is provided "as-is" for your convenience
• You are solely responsible for reviewing, editing, and approving all AI-generated content before publishing
• You retain all rights to content on your site, whether created by you or AI-assisted
• We use third-party AI services for content generation; see our Privacy Policy for details on data handling
• AI-generated content should not be considered professional advice and may require fact-checking

5. Payment Terms

Subscription Plans

We offer multiple subscription tiers with different features and limits:

• Artist Plan: 10 tracks, 500 fans, 5GB storage, custom domain support
• Pro Plan: Unlimited tracks, unlimited fans, unlimited storage, advanced analytics, email campaigns
• Studio Plan: 5 Pro sites included, multi-artist management, team accounts, white-label options

All new accounts start with a 30-day free trial with full Artist tier access. No credit card required to start your trial.

Billing

• Valid payment method is required for paid plans
• Subscription fees are billed in advance on a monthly or annual basis
• We reserve the right to change our pricing at any time with 30 days notice
• If payment fails, we may suspend your account until payment is resolved
• You can cancel your subscription at any time from your account settings
• Upon cancellation, your service will continue until the end of your current billing period

Refund Policy

• Free Trial: No payment required during the 30-day trial period
• Monthly Subscriptions: Non-refundable; service continues until end of billing period upon cancellation
• Annual Subscriptions: Non-refundable; no pro-rated refunds for early cancellation
• Exceptional Circumstances: Refunds may be considered on a case-by-case basis for exceptional circumstances

No Commission Policy

Sonic Bloom does not take any commission from sales, tips, donations, or merchandise sales you receive through your website. You keep 100% of your earnings.

Merchandise Sales (Pro Plan Feature)

If you use our merchandise sales features (available on Pro and Studio plans):

• You are solely responsible for product fulfillment, shipping, and customer service
• Payment processing is handled securely through Stripe
• You are liable for all products you sell (quality, safety, legality, and compliance with applicable laws)
• Return and refund policies for merchandise are your responsibility to establish and honor
• You must comply with all applicable tax laws and collect appropriate sales taxes
• We take 0% commission on merchandise sales; you receive 100% of the sale price (minus payment processing fees charged by Stripe)

6. Cancellation and Termination

Your Rights: You may cancel your account at any time. Upon cancellation, your website will remain active until the end of your current billing period, after which it will be deactivated.

Our Rights: We may terminate or suspend your account if you breach these Terms or engage in conduct that we determine is harmful to other users or our Service.

Data Retention: Upon termination, we will retain your content for 90 days to allow for reactivation. After 90 days, your content may be permanently deleted.

7. Service Availability

We strive to maintain 99.9% uptime for our Service, but we do not guarantee uninterrupted access. We may occasionally need to perform maintenance that temporarily interrupts the Service.

We reserve the right to modify or discontinue the Service (or any part thereof) at any time with reasonable notice to users.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

9. Limitation of Liability

IN NO EVENT SHALL SONIC BLOOM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of California.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on our Service at least 30 days before the changes take effect.

Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.
